THE RELATIONSHIP

These Terms & Conditions (“Terms”) govern the relationship between The Freestone Group Inc. cob Freestone Travel (“Agent”) and the customer (“Customer”). The Agent acts solely as a facilitator for travel services provided by third-party suppliers (e.g., airlines, hotels, tour operators). All travel services are subject to the terms and conditions of these suppliers.

PRICE OF TRAVEL SERVICES

Prices quoted by the Agent for travel services are based on information provided to it by travel suppliers, include all applicable taxes, and are subject to change in accordance with travel supplier terms and conditions. Prices quoted by the Agent do not include any departure tax charged by a country/state/province included on the Booking.

TOTAL PRICE AND PRICE INCREASES

All prices are quoted in Canadian dollars unless otherwise stated and include all applicable taxes.

Mandatory TICO Disclosure: Price increases are permitted. However, no price increases are permitted after the Customer has paid in full. If the price of the travel services is increased and the cumulative increase exceeds 7% (except increases resulting from an increase in HST/GST), the Customer has the right to cancel the contract and obtain a full refund.

TRAVEL INSURANCE

The Agent has offered the Customer trip cancellation and out-of-province health insurance. The Customer acknowledges that they have been advised of the availability
of such insurance and must confirm their acceptance or refusal at the time of booking. Warning: Some countries may refuse entry without proof of medical coverage.

DOCUMENTATION AND ENTRY REQUIREMENTS

For Canadian citizens, a valid Canadian passport is required for all travel outside Canada, and it must be valid for at least 6 months beyond the return date. It is the Customer’s responsibility to obtain all visas, parental consents, or criminal record pardons. Entry to another country may be refused even if the required information and travel documents are complete.

CANCELLATION AND CHANGES

  • By Customer: All deposits, planning fees, and service fees are non-refundable. Any changes must be made through the Agent.
  • By Supplier: If a supplier makes a significant change (e.g., a time change of more than 24 hours or a change in accommodation standard), the Customer’s rights are governed by the supplier’s terms and TICO regulations.

COVID-19 & INHERENT RISKS

The Customer acknowledges that travel during or post-pandemic carries inherent risks, including delays, quarantine, or service interruptions at the Customer’s expense. Living standards and practices at the destination regarding utilities and services may differ from those in Canada.

LIMITATION OF LIABILITY

The Agent exercises care in selecting suppliers but does not control them and is not responsible for their performance, or for any injury, loss, or damage arising from their acts or omissions. The Agent’s total liability for any claim is limited to the amount of professional fees paid directly to the Agent.

FORCE MAJEURE

The Agent shall not be liable for failure to perform due to events beyond its control, including but not limited to: natural disasters, war, terrorism, epidemics, or government restrictions. In such events, the Agent’s obligations are suspended.

General Provisions

NOTICE

Notice may be provided either in writing, to the last address provided by the Customer/Agent, delivered by hand, or by email or other electronic method, in which case it will be effective only when it is acknowledged by the other party.

PARTIAL VALIDITY

If any provision(s) of these Terms are held by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force without being impaired or invalidated in any manner.

MODIFICATION

These Terms may be modified by the Agent at any time.

LAW GOVERNING TERMS

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario.

FORUM FOR DISPUTES

The courts of Ontario shall have exclusive jurisdiction over the resolution of any dispute, controversy or claim arising out of or in relation to these Terms.

SUCCESSORS AND ASSIGNS

These Terms shall be binding upon and shall inure to the benefit of the customer/Agent and their successors and assigns, administrators and executors.

COMPLETE UNDERSTANDING

These Terms represent the complete understanding of the Customer/Agent with respect to the booking of the travel services and specifically exclude any representation made that is not included in these Terms.

WAIVER

No waiver of any provision(s) of these Terms shall be deemed, or shall constitute, a waiver of any other provisions, whether or not similar, nor shall any waiver constitute a continuing waiver.
